The Michigan House has moved forward with a bill introduced by state Representative Jamie Thompson, aimed at protecting sensitive medical information across the state. The proposed legislation, House Bill 4242, mandates that healthcare providers in Michigan use electronic health record technology physically maintained within the United States or Canada for storing patient data.
Representative Thompson from Brownstown expressed concern over potential breaches of medical records, which could lead to insurance fraud and identity theft. "People in communities I represent and in Michigan should have peace of mind knowing sensitive information within their medical records isn’t at risk," she stated. She emphasized the profound impact such breaches could have if they originate from foreign adversaries of the United States.
Thompson highlighted that unsecured breaches affecting 500 or more individuals must be reported to the Secretary of Health and Human Services. In March alone, nearly 1.8 million people nationwide were affected by healthcare data breaches.
The legislative package includes additional measures designed to safeguard against foreign influence. These measures aim to prevent foreign entities from collecting sensitive information through prohibited apps on government devices and prohibit public bodies from entering agreements with concerning foreign countries. They also ensure that public economic incentives are not awarded to these entities and protect Michiganders' safety by preventing concerning entities from purchasing land near military bases and critical infrastructure.
The bills target several nations listed on the federal watch list: China, Russia, Iran, North Korea, Cuba, Venezuela under Nicolas Maduro's regime, and Syria.
House Bills 4233-35 and 4238-42 will now proceed to the Senate for further consideration.
