State Representative James DeSana has introduced legislation aimed at repealing Michigan’s compliance with the federal REAL ID Act. This move comes as the federal mandate for REAL ID takes effect, requiring compliant identification or a passport for domestic flights and access to certain federal facilities.
DeSana argues that “REAL I.D. violates our Constitutional rights,” specifically citing concerns over the Tenth Amendment, which reserves powers not delegated to the federal government to the states. He believes that by federalizing driver’s licenses, REAL ID undermines state sovereignty and individual privacy protections under the Fourth Amendment.
The proposed plan seeks to repeal Michigan’s compliance with the REAL ID Act, prevent state agencies from enforcing or expanding its provisions, and reassert state control over licensing and identification systems.
House Bills 4473 and 4474 have been introduced in response to what DeSana describes as federal overreach under the REAL ID Act. The act grants sole authority to the Secretary of Homeland Security to expand the definition of “official purposes” without Congressional approval, raising concerns about potential expansions into areas like banking and healthcare.
DeSana also warns against a centralized digital ID system, highlighting risks associated with enforcement tools such as a “three strikes” tracking database. He stated, “In addition, a digitalized National I.D. can quickly and easily enable a global ID system, vaccine passports, and social credit system.”
He emphasizes that Americans are now subject to a law they did not request or understand fully. “Michigan must draw the line and defend the Constitution,” he added.
