Michigan lawmakers propose bipartisan plan for next of kin medical decision-making

State Representatives Jamie Thompson and Angela Witwer have introduced bipartisan legislation aimed at establishing Michigan as a “Next of kin” state for medical care. The proposed bills seek to simplify the process for families making urgent medical decisions when a loved one becomes incapacitated without a medical power of attorney.

Currently, Michigan families face complex legal hurdles, including court petitions for guardianship, before they can make necessary medical decisions in such situations. These delays can lead to significant consequences.

The new legislation by Thompson and Witwer proposes a straightforward process for healthcare decisions by establishing a patient surrogate through the Next of kin framework. This term traditionally refers to the closest living blood relative, but determining this can become legally complicated without clear guidelines.

Thompson shared her personal experience with this issue: “As a nurse, I’ve seen how this impacts patients and families,” she said. “This issue is also personal for me. When my father was gravely ill and passed away in 2023, my family experienced firsthand the emotional and legal challenges caused by the lack of a clear next of kin framework.” She emphasized that these bills aim to provide clarity and support during critical times, allowing families to focus on their loved ones rather than legal proceedings.

The proposed House Bills 4418-19 have been forwarded to the House Judiciary Committee for review.
